According to Kauai's local newspaper, The Kauai County Council passed a bill with the following changes:

1) Exempts owners of multi-family vacation rentals within the VDA (Visitor Destination Area) from registration requirements.

2) Removes the sign requirement, however, owners must designate a contact person to be available 24 hours, 7 days a week.  This contact information is to be provided to neighbors adjacent to and directly across subject vacation rental, the Kauai Police and Civil Defense Departments.

3) Requires owners of vacation rentals located outside of VDA to provide a sworn affidavit that the property was being used as a vacation rental on an ongoing basis prior to the effective date of the ordinance.

Although the notice in the Kauai newspaper states that "Those who have already filed an NCU application should submit an affidavit as soon as possible.", I can tell you from personal experience that the affidavit is not yet available.  I visited the Planning Department today and was told that the form is not ready.  I will be following this requirement so check back as I will definitely post a blog when I am able to get this done.
